Personal Directive
In Alberta a document that assigns decision making powers over health and wellbeing of a person is called Personal Directives. A Personal Directive is executed by a person prior to them no longer having mental capacity.

A Personal Directive is governed by provincial legislation, specifically in Alberta the
Personal Directives Act (Alberta).
Personal Directives are also referred to in other jurisdictions as living wills, or advanced care or advanced medical directives.
There needs to be careful consideration prior to entering into a Personal Directive as to who will have decision making, how their decision making will be activated, and what decision-making powers will they have. We call these designated people “Agents”.
An individual taking on the role of an Agent should be made aware of what specific circumstances need to occur to become the Agent, and they should be aware of their responsibilities to the person when acting as an Agent.
At Family Central Law we regularly assist clients in drafting of a personalized personal directive.
Our office strives to craft a process for engagement, review and completion of this document that is easy for you.
