Guardianship Applications

When a person does not have a Personal Directive in place and subsequently loses mental capacity, it can create a gap in decision making for all non-financial issues. “Non-financial” issues concern the fundamental health and wellbeing related decisions that need to be made on behalf of a person who lacks the ability themselves to make these decisions.

A loss of capacity could be one that is short or long term, and in either situation life continues on and decisions need to be made concerning these personal health and wellbeing decisions.

Due to medical advancements and treatments, obtaining authority to have decision making over a person when they have a sustained lack of mental capacity is very important. This becomes even more important when factoring in this authority may need to be in place for many years.

A guardianship application requires very specific requirements and information to be completed for an application to be heard in the Alberta Court of King’s Bench.

With all guardianship applications the Office of the Public Guardian and Trustee will conduct a review and will speak to the proposed represented adult.
