Annulment

• When there was not the technical requirements for a marriage to be valid;
• When there has been no sexual relations between the married spouses;
• When there has been a fraud;
• When one or more of the parties was intoxicated to the point of not being able to consent to the marriage;
• When there has been coercion, duress, physical violence; and/or
• When there has been bigamy (a person is already married to another).

To obtain an annulment a person must go through a specific application process with the Alberta Court of King’s Bench.    This application process could be one that is contested or uncontested.   

Obtaining an annulment involves moving forward quickly so that the issue is heard without delay.   Delay in seeking this relief can greatly hurt the chances of the success of this type of application.
