Annulment of Marriage

Calgary Family Central Law Firm - Area of Practice

Annulment

An annulment describes the legal treatment of a marriage where it is declared that the marriage never occurred.

Annulment

In Alberta there are specific grounds where an annulment of a marriage can be granted by a Justice of the Alberta Court of King’s Bench.

These situations are limited and include instances where there have been no sexual relations, where there has been a fraud, coercion, duress, physical violence, or bigamy (a person is already married to another).

To obtain an annulment a person must go through a specific application process with the Court of King’s Bench where specific evidence needs to be provided.

Obtaining an annulment will necessitate moving forward quickly so that the issue is heard without delay.
